IUMS considers ousting legitimate president prohibited sedition, condemns violence

All praise be to Allah and peace and blessings be upon God’s messenger, on his family, companions, and followers;

The International Union of Muslim Scholars has followed with great concern the developments in Egypt and the latest situation, the concurrent tensions and clashes between protesters in streets and between security men where a number of victims have died or were injured who are all Egyptian citizens, where facilities have been vandalized, or possessions, sanctities, freedoms, and rights, have been violated. These incidents were accompanied by the unconstitutional ousting of the legitimate authority, and suppression and prevention of the media, as security forces stormed their headquarters barbarously, not to mention the fierce attack on Islamists who won the trust of the majority of the Egyptian people in free, transparent elections, the majority of whose leaders were arrested, in addition to burning their offices, and killing a number of them before the eyes of security and police forces. This and other incidents threaten uncontainable evils should reasonable people fail to rectify this situation. Our fear is that their patience will be exhausted or that the enemies will use this situation to repeat the scenario of Algeria with Islamists and that Egypt would drown in a sea of blood and seditions – God forbid – and May Allah protect Egypt.

In view of this grave situation, the IUMS asserts the following:

1- The IUMS with its board of trustees, scholars and general secretariat reaffirms the edict of scholar Al-Qaradawi concerning the prohibition of diversion and ousting the legitimacy and elected president, and the illegitimacy of procedures made to oust him, since any action based on illegitimate procedure is illegitimate legally and constitutionally as mentioned in the edict.

2- At the same time, the union strongly calls for the necessity of abandoning violence and preventing the assault from all sides on public and private property, lives, and sanctities.

The union pleads to everyone to be mindful of Allah regarding the souls, sanctities, and money made prohibited by Allah equally to Mecca, the holy months, and Holy Mosque. Be mindful of Allah in spilling the blood as Allah Almighty said that

{if any one slew a person - unless it be for murder or for spreading mischief in the land - it would be as if he slew the whole people: and if any one saved a life, it would be as if he saved the life of the whole people.} [Quran 5:32] and that {If a man kills a believer intentionally, his recompense is Hell, to abide therein (For ever): And the wrath and the curse of Allah are upon him, and a dreadful penalty is prepared for him.} [Quran 4:93]. Numerous hadiths also prove that the sanctity of a believer is greater than that of the Holy Mosque and that "A believer is in a space of his religion unless they spill a prohibited blood”. So we demand everyone: the police, the army, and protesters to remain steadfast in the peacefulness of protests, and prevent infiltrators and thugs from tarnishing the atmospheres of democracy and peacefulness as this is particularly the responsibility of the army, security, police as it is the responsibility of every Muslim and every citizen in general.

3- The union condemns the incidents accompanying the illegitimate deposition if suppression, the closing down of some television channels, storming Aljazeera Live Egypt channel and other suppressive procedure that are incongruent to Islam, the deep-rooted Egyptian civilization, as well as human rights and dignity.

The union also condemns keeping the legitimate president in an disclosed location, threatening him of prosecution, the fierce attack on Islamists, placing some of them in prisons, including the speaker of the elected Egyptian parliament, and some of its members who won Egyptian people’s trust in transparent elections.

4- The union calls the great Egyptian people, especially the revolutionaries who were united around the goals of the great Jan 25 revolution, to unite around these goals, protect their revolution, its great gains, democracy, and end injustice, corruption and tyranny in acknowledgement of the martyrs and sacrifices of honorable Egyptians that made sacrifices for the sake of freedom, dignity, justice and stability.

5- The union demands the wise and reasonable figures in Egypt to intervene immediately to bring back the legitimate authorities, protect the great Egypt from seditions, both explicit and implicit, and demands all free people in the world and those defending the values of freedom, democracy, and a constitutional life to intervene peacefully and positively to protect mutual human values, return rights to its owners, respect the will of the Egyptian people which was expressed twice, in choosing the president, and another in voting by a two-third majority for the constitution. For if the dignity of a people is humiliated, what good is left there, and what illusory interest can be favored?!!

It is illogical to demand the National Coalition for Supporting the Legitimacy to return to their homes and mosques despite the fact that they call for the return of legitimate authorities and respecting the will of the Egyptian people while at the same time others are not required to return to the truth and legitimate procedure?

6- The union values countries that stood by the legitimate authorities, particularly backing them in this critical stage and wishes that all democratic, free, and peace-loving nations will deal with the issue of constitutional legitimacy in Egypt according to principles of transparency, loyalty, and honesty away from double standards and selectivity.

7- The union warns all the countries of the region and its people the dangers of silence about and disregard of the violation of constitutional legitimacy and its subversion as armed coups against electoral and constitutional legitimacy would represent a dangerous first example that has the potential of threatening the security and stability of the region.

8- The union urges all the noble brethren who stood by the legitimacy, among them Islamists and others on the political scene in Egypt, to preserve the peacefulness of protests, prevent infiltrations meant to stir sedition, as they should be mindful of Allah regarding blood spilling, and assault on possessions and sanctities, which count among the major sanctities.

And we have no doubt that Allah would defend His soldiers, His religion, but for every matter there is an ordained timing and destiny, and that it is another great test after which a soon victory would come God wills it.

{And Allah has full power over His affairs but most among mankind know it not}
